These Terms and Conditions set out the basis on which Waste Clearance Greenwich provides waste and rubbish collection, removal and clearance services within our service area in the United Kingdom. By booking a service, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and Waste Clearance Greenwich.
In these Terms and Conditions:
Customer means the individual, business or organisation that requests and receives waste clearance services.
Services means waste, rubbish and unwanted item collection, removal, loading, transportation and related activities provided by Waste Clearance Greenwich.
Waste means any materials, items, refuse, junk or rubbish presented for removal as part of the Services, excluding any prohibited items as set out in these Terms and Conditions.
Contract means the agreement between Waste Clearance Greenwich and the Customer for the provision of the Services, incorporating these Terms and Conditions and the details agreed at the time of booking.
Waste Clearance Greenwich provides waste collection and clearance services for domestic and commercial customers. Services may include collection of household waste, garden waste, bulky items, office rubbish, light construction debris and other non-hazardous waste streams, subject to applicable regulations and these Terms and Conditions.
We reserve the right to refuse removal of any items or materials that in our reasonable opinion are hazardous, prohibited, unlawful to handle, or beyond the agreed scope of work, including but not limited to certain chemicals, asbestos, clinical waste, pressurised containers, explosives, or any other items restricted by UK waste legislation.
3.1 Service Requests
You may request a booking by contacting Waste Clearance Greenwich via telephone, email, online form or other approved channels. At the time of enquiry, you will be asked to provide accurate details of the waste to be collected, including type, approximate quantity, access conditions and location.
3.2 Estimates and Quotations
Based on the information provided, we may give an initial estimate or quotation. All estimates are subject to confirmation at the time of collection. If the volume, weight, access conditions, parking arrangements or nature of the waste differ from those described at the time of booking, we may adjust the price accordingly before commencing the work.
3.3 Booking Confirmation
A Contract is formed only when we confirm acceptance of your booking, verbally or in writing, and provide a scheduled date or time window for the Services. We reserve the right to refuse any booking at our discretion.
3.4 Access and Parking
You are responsible for ensuring adequate access for our team and vehicle at the agreed time. Any necessary permits, parking arrangements or authorisations for access must be in place in advance. Waiting charges or additional costs arising from access or parking issues may be added to your final invoice.
4.1 Arrival Windows
We will provide a time window for arrival and will use reasonable endeavours to attend within that period. Times provided are estimates only and are not guaranteed. We accept no liability for delays caused by traffic, weather, accidents, access problems or other circumstances beyond our reasonable control.
4.2 Customer Presence
Unless otherwise agreed, the Customer or an authorised representative must be present at the property at the time of service to provide instructions, grant access and confirm the waste to be removed. If no one is present, we may cancel or re-schedule the job and a wasted journey or cancellation fee may apply.
4.3 Loading and Removal
Our team will load the agreed waste into our vehicle, subject to health and safety requirements and any access limitations. We reserve the right to refuse to move items that are excessively heavy, unsafe, contaminated, infested, or located in an area that poses a health, safety or structural risk.
4.4 Condition of Premises
The Customer is responsible for ensuring that the premises and any items to be removed are safe and structurally sound for handling and transportation. We will take reasonable care when carrying out the Services, but we are not responsible for pre-existing damage, structural defects, or damage resulting from the movement of unusually large, heavy or awkward items where the Customer has requested their removal.
5.1 Legal Compliance
Waste Clearance Greenwich operates in accordance with applicable UK waste management and environmental regulations. All waste will be transported and disposed of using authorised carriers and disposal facilities wherever required by law.
5.2 Prohibited Materials
We do not collect or handle certain hazardous or regulated materials. These may include but are not limited to asbestos, clinical and medical waste, radioactive materials, gas cylinders, explosives, large quantities of chemicals, certain types of oils, and other specialist or controlled wastes. If such items are discovered at the time of collection, we may refuse them and adjust the booking or charge a call-out fee.
5.3 Waste Ownership and Transfer
Upon loading the waste into our vehicle and receiving full payment, ownership of the waste transfers from the Customer to Waste Clearance Greenwich or its authorised partners. We will then be responsible for its lawful transportation, treatment, recycling or disposal.
5.4 Duty of Care
The Customer has a legal duty of care to ensure that their waste is transferred only to an authorised person. By instructing us, you confirm that the waste is yours to dispose of and that it does not contain prohibited or unlawfully held items.
6.1 Pricing Structure
Prices are generally based on the volume and type of waste, weight, loading time, access conditions and any additional services requested, such as dismantling or extra labour. A final price will be confirmed with you before work commences wherever reasonably possible.
6.2 Variations
If, on arrival, the waste volume or nature differs significantly from the description given at the time of booking, or if there are unforeseen access or parking issues, we may revise the price. If you choose not to proceed at the revised price, a call-out or cancellation fee may be charged to cover our costs.
6.3 Payment Terms
Unless otherwise agreed in writing, payment is due in full on completion of the Services on the day of collection. We may accept various methods of payment, including cash, debit or credit card, or bank transfer, subject to availability at the time of service.
6.4 Late or Non-Payment
If payment is not made when due, we reserve the right to charge interest on the outstanding amount at the statutory rate and to recover any reasonable costs incurred in the collection of overdue sums. We may also suspend further services until all outstanding amounts are settled.
7.1 Customer Cancellations
If you wish to cancel or reschedule a booking, you must notify us as soon as reasonably possible. Where you provide at least 24 hours notice before the scheduled arrival time, no cancellation charge will usually apply. For cancellations with less than 24 hours notice, we may charge a reasonable cancellation fee to contribute to our wasted costs.
7.2 Our Right to Cancel
We may cancel or postpone the Services at any time if we are unable to carry out the work safely, lawfully or in accordance with these Terms and Conditions. This may include situations involving hazardous waste, unsafe access, abusive behaviour, or severe weather or traffic conditions. Where reasonably practicable, we will offer an alternative appointment. We will not be liable for any loss arising from such cancellation or postponement, other than refunding any pre-paid amount relating to the cancelled service.
7.3 Wasted Journeys
If our team attends the property at the agreed time but is unable to carry out the Services due to reasons within the Customer’s control, including lack of access, absence of the Customer, lack of parking, or misdescription of the waste, a wasted journey charge may be applied.
8.1 Accurate Information
You must provide accurate and complete information regarding the waste, the property and access arrangements at the time of booking. If any details change, you must inform us promptly.
8.2 Preparation of Waste
Unless otherwise agreed, waste should be reasonably accessible, not illegally stored, and free from dangerous contamination. Where items require dismantling, disconnection or specialist handling, this must be agreed in advance.
8.3 Behaviour and Safety
You must not instruct our team to undertake any activity that is unsafe, unlawful or outside the agreed scope of the Services. We reserve the right to withdraw our staff if they are subjected to abusive, threatening or unsafe conditions.
9.1 General Liability
We will perform the Services with reasonable skill and care. If we are found liable for loss or damage arising from our negligence or breach of contract, our liability shall, to the fullest extent permitted by law, be limited to the value of the Services provided under the relevant Contract.
9.2 Exclusions
We shall not be liable for any indirect or consequential loss, including loss of profits, loss of business, loss of opportunity or loss of goodwill, whether arising in contract, tort, or otherwise. We are not liable for any items that the Customer intended to retain but which are removed in error where those items were not clearly identified and separated from waste.
9.3 Customer Property
It is your responsibility to check that no valuable or personal items are mixed with the waste. Once removed, waste is not normally recoverable. We do not accept liability for any cost of retrieval or replacement of such items unless removal was due to our deliberate misconduct.
9.4 Events Beyond Our Control
We are not liable for any failure or delay in performing our obligations where such failure or delay is due to events beyond our reasonable control, including but not limited to extreme weather, traffic disruption, accidents, strikes, civil disturbances, or acts of government or regulatory authorities.
Waste Clearance Greenwich maintains appropriate insurance cover in connection with the Services. Details of cover can be provided on request. Our liability remains limited as set out in these Terms and Conditions, and the existence of insurance does not extend or increase that liability.
If you are dissatisfied with any aspect of our Services, you should notify us as soon as possible, providing full details of the issue and any supporting information. We will investigate reasonable complaints in good faith and seek to resolve them promptly, which may include offering a remedy where appropriate.
We collect and process personal information necessary for administering bookings, delivering Services, taking payment and managing our relationship with you. We will handle personal data in accordance with applicable UK data protection law. By using our Services, you consent to such processing for the purposes described.
We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that Contract. Updated terms may be made available on request or through our usual communication channels.
If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a competent authority, such provision shall be severed from the remaining provisions, which will continue to be valid and enforceable.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
